Can My Employer Force Me to Return to Light Duty Work in Virginia?

Can My Employer Force Me to Return to Light Duty Work in Virginia?

After a work injury in Virginia, it is common for employers to push injured workers back to the job as quickly as possible — often through a light duty assignment. If you are still recovering and your employer is pressuring you to return, you may be wondering: can they actually force me to go back to work on light duty?

The short answer is no — your employer cannot physically force you to return. However, the consequences of refusing can be significant under Virginia workers’ compensation law. As a workers’ compensation attorney in Roanoke, Virginia, I want to break down what the law actually says and help you understand your options.

Virginia Law on Returning to Light Duty Work

Under Virginia Code § 65.2-510, an employer can offer what the law calls “selective employment” — modified work within your medical restrictions — and if you refuse that offer without good cause, your temporary total disability (TTD) benefits can be reduced or suspended.

This is the leverage employers use. While they cannot drag you back to the workplace, they can ask the Virginia Workers’ Compensation Commission to cut off your wage benefits if you turn down a legitimate offer.

When Your Employer Cannot Force You Back

There are important limitations on an employer’s ability to pressure you into returning to light duty work:

Your Doctor Has Not Cleared You

If your treating physician has not released you to return to any form of work, your employer cannot override that medical opinion. The light duty offer must be consistent with your current medical restrictions. If your doctor says you cannot work at all right now, that medical opinion carries significant weight with the Commission.

The Position Exceeds Your Restrictions

Even if your doctor has cleared you for some limited activity, the specific light duty job must fall within those restrictions. If your doctor says you cannot lift more than five pounds and the offered position involves lifting ten-pound boxes, you are justified in declining. Make sure to have your doctor review the written job description before accepting or refusing.

The Job Is Not Legitimate

An employer cannot create a made up light duty job with no real duties and then penalize you for refusing it. The position must be genuine selective employment — a real job with real tasks that contribute to the employer’s business. If the job is nothing more than a pretext to eliminate your benefits, you may have grounds to challenge it.

What About “At-Will” Employment?

Virginia is an at-will employment state, which means your employer can generally terminate your employment for any reason. However, Virginia law does provide some protection for injured workers. Under Virginia Code § 65.2-603, it is unlawful for an employer to fire you solely because you filed a workers’ compensation claim. If your employer terminates you in retaliation for asserting your workers’ comp rights, you may have a separate legal claim.

What You Should Do If You Are Being Pressured

If your employer is pushing you to return to light duty before you feel ready, or if the offered position does not seem right, here is what I recommend:

  1. Communicate with your treating physician. Make sure your doctor is aware of the specific duties involved in the light duty offer and whether they fall within your current restrictions.
  2. Request the offer in writing. Get a formal, written job description that details the duties, hours, physical demands, and pay.
  3. Do not simply ignore the offer. Failing to respond to a light duty offer can be treated as an unjustified refusal, which could put your workers’ comp benefits at risk.
  4. Document any pressure or threats. If your employer or the insurance adjuster threatens you or uses intimidation tactics, keep a written record.
  5. Consult with an attorney. A workers’ compensation lawyer can help you evaluate the offer and respond in a way that protects your claim.
