Understanding Uber’s $1 Million Insurance Policy and Its Scope in Virginia

If you have recently been involved in an accident while driving or riding as a passenger with Uber, you likely have questions about your rights, insurance coverage, and who will pay for your medical expenses.

One common misconception is the belief that Uber’s million-dollar insurance policy automatically provides comprehensive coverage for every injury sustained during Uber rides. However, the reality can be more complicated. It’s important to understand when exactly Uber’s million-dollar policy becomes active, and whether it applies to your case.

Certainly, Uber maintains significant liability insurance, but coverage in Virginia depends on the timing and specific circumstances of the accident.

When Does Uber’s Million-Dollar Policy Apply in Virginia?

Uber (and other ride-share companies) carry commercial liability insurance that kicks in once an Uber driver has accepted a ride request and is either actively traveling to pick up the passenger or transporting passengers. According to Uber’s Virginia insurance guidelines, this period—labeled as “Period 2” and “Period 3” on Uber’s coverage timeline—is when the policy provides up to $1 million in liability insurance as well as uninsured or underinsured motorist coverage.

Uber’s coverage typically includes:

– Liability insurance coverage of up to $1 million in total bodily injury and property damage per covered incident.
– Uninsured or underinsured motorist (UM/UIM) insurance coverage up to $1 million per accident.

If a driver has not yet matched with a passenger—corresponding to “Period 1” in Uber’s terminology—the million-dollar coverage does not apply. Instead, Virginia law (§ 46.2-2099.50) allows lower policy limits during Period 1. Specifically, the driver must have coverage of at least $50,000 per person and $100,000 per accident for bodily injury, and $25,000 per accident for property damage during this time.

So What Does Uber’s Insurance Cover in an Accident?

It depends on whether you are a driver, a passenger, or an occupant of another vehicle struck by an Uber driver, to determine what Uber’s insurance will cover if you are in an accident.

Uber drivers: If the accident is your fault, you will not be able to get workers’ compensation benefits from Uber if you are hurt at work because you are classified as an independent contractor, not an employee. We can fight back on your classification, but most courts have concluded that ride-share drivers are contractors and thus not covered by workers comp. However, if the accident is someone else’s fault – e.g., the passenger assaulted you, or another car struck you – then we can help you recover against that other party’s insurance carrier in a personal injury claim.

Uber passengers: If your Uber driver caused the accident, then you can file a claim against the driver that must be paid by Uber’s insurance coverage. If another motorist struck your Uber ride, then you would recover against that motorist’s insurance policy. In some cases, where it is not clear who caused the accident, you may be able to settle with both policies.

Other motorists and pedestrians: If you have been injured by an Uber driver, you can seek recovery directly against Uber for a variety of personal injury claims, including injuries from the driver’s failure to obey the rules of the road, and potential from Uber’s failure to properly screen and hire safe drivers. Uber’s million-dollar commercial policy would apply.

Even with Uber’s ample insurance coverage, claims can still face disputes. Insurance companies often contest responsibility, fault, or the extent of injuries. It’s not uncommon for claims adjusters to devalue injuries, minimizing initial insurance offers and forcing injured individuals into lengthy negotiations or even litigation.
